Casual to Career - - - Arbitration Victory

Chris Ivanyi, Studio Projectionist in the Film and TV Department at UCLA who has been working for 6 years as a 60% casual employee, filed a TX Grievance in order to enforce the contract language, which clearly states:
Article 29 Positions: at Career positions are positions established at a fixed or variable time at fifty percent (50%) or more of full-time which is expected to continue for one (1) year or longer.
After reviewing the facts and analyzing the case the Arbitrator ruled that based on the testimony and documentary evidence, and the findings and conclusions set forth above, the undersigned renders the following reward:
  1. The grievance will be sustained.
  2. Christopher Ivanyi will be converted from casual to career status at a 60% appointment, elective retroactively as of August 21, 1998.
  3. Mr. Ivanyi shall be made whole for any loss of pay or benefits.
  4. The undersigned (Arbitrator) will retain jurisdiction for 90 days to resolve any disputes over implementation of the award.
This decision has direct impact on over 700 additional TX casual employees who can now file for casual to career conversion based on the same criteria used to judge the Ivanyi case. Also, this sets precedence for UPTE Research Professionals, Health Care Professionals and Administrative Staff Professionals whose central and policy language fits the criteria used to convert Mr. Ivanyi to career status with full benefits and retirement entitlements.
