UPTE HX Bargaining Bulletin #5

The HX Bargaining committee met with UC in Sacramento on June 27- 29th. The following is a report of our progress:

Art. 10: Holidays
Your HX bargaining team proposed that employees receive holiday time in accordance with their normal hours of work. For example, a 4day/10 hour shift employee would receive 10 hours of holiday time.

Art. 12: Job Posting
The University and Bargaining team have had lengthy discussions regarding the local posting procedures at each campus/medical center. The bargaining team has received complaints that employees do not receive postings in a timely manner.

The University does not want to post a printed job announcement in each location. Currently the University posts electronically and in hard copy at the Human Resources office.

Art. 13: Lay Offs
UC has proposed changes to the selection for lay-off which the HX bargaining team has rejected. Your bargaining team has proposed new language to retain senior employees who have the ability to learn necessary skills within 30 days, so that less senior employees would be laid off first.

Art. 17: Medical Separation
Language was changed to better meet the requirements of the ADA (Americans with Disabilities Act). The modifications do not change the intent of current contract language.

Art. 24: Parking
Your bargaining team has proposed freezing the parking rates for the life of the agreement. The University has not responded to this proposal.

Art. 27: Positions
Much discussion has taken place regarding section D4, overtime payment. There is no agreement yet regarding this.

Art. 30: Reasonable Accommodation
Proposed changes to this article comply with the ADA and provides for permanent positions if an employee becomes disabled.

Art. 32: Release Time for Bargaining
The University is trying to restrict the number of HX representatives on further bargaining committees. We have rejected this proposal.

Art. 35: Job Abandonment/Resignation
Your union bargaining team has proposed improved language regarding sect A 4, final paycheck and section B job abandonment.

Art. 36: Sick Leave and Art. 41: Vacation Time
The University has proposed a PTO (Paid Time Off) article that reduces the level of benefits paid out under Articles 36 and 41.
JUST SAY NO TO PTO !!!

Art. 45: Workplace Committees
Your union bargaining team has proposed an increase of representation to local labor/management meetings. The team also addressed the issues of staffing levels, patient needs, assignments and work levels. The University has not responded at this time.

Fair and Respectful Treatment
Not surprisingly, the University has rejected a new proposed article in the HX agreement – Fair and Respectful Treatment. This is current TX/RX contract language and has been for years. Your HX team will not back down on this issue because we believe we deserve to be treated fairly and with respect by management.
