| RX/TX Bargaining Report #8
Lawrence Berkeley National Laboratory/UCOP (April 8 & 9, 2013)
Negotiations for the TX and RX contract continued this past April 8 at the Lawrence Berkeley National Laboratory and April 9 at UCOP Kaiser Building in Oakland.
UC proceeded with unilateral demands on what proposals UPTE will make and when. UCOP’s Chief Negotiator, directed harassing comments towards UPTE's Chief Bargainer and Team while our member speakers were still in the room. In solidarity, the UPTE Bargaining team and Union members walked out together due to UC’s insistence on making clearly unreasonable demands for proposals while they refused to accept a proposal UPTE was prepared to submit. We continue to bargain in good faith and in the best interests of our members. We will not be dissuaded from our goals.
UC submitted no proposals this session. The UPTE Team continues to submit thoughtful, quality proposals. Among the proposals passed during this session was contract Article 13, HOURS OF WORK, which defines our work & break schedules. It also defines other types work hour status such as On-Call, Changing and Clean Up, Travel, Call Back etc.
The Article 13 RX submitted to our bargaining team by UC in March was seriously flawed and required many hours of intense scrutiny to re-word it properly. The TX version also required much revision. The TX and RX versions of Article 13 were significantly different. Also, there were serious errors in Appendix A, On Call pay, which have been fixed in UPTE’s Article 13 TX/RX submitted versions. Together these articles were intensely worked on for two days and submitted to UC at the end of the day on April 9.
Along with the time spent on Article 13, the team also finished work on and submitted Article 7, Corrective Action; Article 25, Non-discrimination in Employment; and Article 30, Personnel Files. UPTE also requested information regarding the 2013 Federal Sequestration and how it may affect RX/TX employees at Lawrence Berkeley National Lab.
This session also saw very good turnout of members who came to show their solidarity and voice their resolute opposition to UC's pension proposals. Among members who spoke, the Radiation Protection Group was well represented. All of our union members stood up and spoke against the two-tiered system.
The bargaining team is making excellent progress in writing contract proposals worthy of our members. As indicated by the amount of time and work done on Article 13 alone, we are taking the time needed to review the contract and update language. There is a great deal of UC language that is inherently dangerous to our financial well-being in the current contract language. It requires diligent, careful intense scrutiny, time consuming writing, review and rewriting to ensure our contract is fair and protective of our rights and financial well-being.
